[70 N.Y.2d 547 Page 549] Opinion OF THE COURT Defendant was convicted, after a jury trial, of criminal sale of a controlled substance in the first
degree and criminal possession of a controlled substance in the first and third degrees. After originally affirming his conviction
(124 A.D.2d 1076), the Appellate Division unanimously granted defendant's motion for reargument, vacated its prior order,
reversed the judgment of conviction, and remanded the case for a new trial on the ground that the People violated the Rosario
rule (see, People v Rosario, 9 N.Y.2d 286; CPL 240.45 [1] [a])1 and that the violation required reversal. A Justice of
the Appellate Division granted the People leave to appeal. The sole issue is whether the prosecution's total failure to deliver
Rosario material to defense counsel as required by the rule is subject to harmless error analysis.
